sync checkpatch.pl with upstream Linux #864

Reported by Andrew Boie:

As a developer, I would like checkpatch.pl updated to the latest upstream changes to reduce the number of false-positives when CI invokes it to review patches.

As a zephyr maintainer, I would like any local changes to checkpatch.pl contributed upstream so that we have an easier time updating to newer versions of the script.

Because of the recent change to use the new Jira workflow, this story got mistakenly Closed when it should have been put into the Merged state. I'm moving it to the Merged state now.

What was specifically done here?

Did we upstream any work to Linux? If so, what was upstreamed? Did we rebase onto upstream checkpatch? If so, what are the Gerrit IDs showing that we have done this? I don't have much to go on with respect to verifying this issue.

we synced with the latest checkpatch version from the linux kernel and kept local modification, nothing was upstream, the changes we have are zephyr specific.
