the first (nested) new tab was opened using Chrome's new tab button (same result using ctrl+t), and the bottom new tab was created using Sidebar+'s new tab button (the big + which can be seen at the bottom of the screenshot).
In my opinion, new tabs should always appear as root tabs in three view. In any case, the behavior should be consistent.
